CONCERNING
OVERTIME WORK AND GIVING OVERTIME ALLOWANCE FOR CIVIL GOVERNMENT EMPLOYEE

THE MINISTER OF FINANCE,

Considering:

• a. to create a legal framework to increase spirit of working to process tasks outside of working time, it is necessary to give overtime allowance for Civil Government Employee;
• b. that in Regulation of the Minister of Finance No. 96/PMK.02/2006 concerning Standard of Cost for Fiscal Year 2006 which arranged overtime allowance rate and overtime food allowance;
• c. that based on consideration as described in paragraphs a and b above, it is necessary to stipulate Regulation of the Minister of Finance concerning Overtime Work and Giving Overtime Allowance for Civil Government Employee;

In view of:

• 1. Law No. 8/1974 concerning Principles of Employee Affair (Statute Book Republic of Indonesia Year 1974 No. 55, Supplement to Statute Book No. 3041) as has already been amended with Law No. 43/1999 (Statute Book Republic of Indonesia Year 1999 No. 169, Supplement to Statute Book No. 3890);
• 2. Law No. 17/2003 concerning State Financial (Statute Book Republic of Indonesia Year 2003 No. 47, Supplement to Statute Book No. 4286);
• 3. Law No. 1/2004 concerning State Treasury (Statute Book Republic of Indonesia Year 2004 No. 5, Supplement to Statute Book No. 4355);
• 4. Law No. 15/2004 concerning Inspection of Management and Responsibility for State Financial (Statute Book Republic of Indonesia Year 2004 No. 66, Supplement to Statute Book No. 4400);
• 5. Presidential Decision No. 42/2002 concerning Guideline for Implementation of State Revenue and Expenditure Budget (Statute Book Republic of Indonesia Year 2002 No. 73, Supplement to Statute Book No. 4212) as already amended with Presidential Decision No. 72/2004 (Statute Book Republic of Indonesia Year 2004 No. 92, Supplement to Statute Book No. 4418);

REGULATION OF THE MINISTER OF FINANCE CONCERNING OVERTIME WORK AND GIVING OVERTIME ALLOWANCE FOR CIVIL GOVERNMENT EMPLOYEE

CHAPTER I
GENERAL PROVISIONS

Article 1

In this Regulation of the Minister of Finance, the meaning of:

1. Civil Government Employee referred to Civil Government Employee as described in Law No. 8/1974 concerning Principles of Employee Affair as has already been amended with Law No. 43/1999, in State Ministries/Agencies environment.

2. Overtime is do all tasks should be done by Civil Government Employee in certain time outside of working time as stipulated in every Agency and Government Office.

CHAPTER II
GIVING OVERTIME ALLOWANCE

Article 2

(1) Civil Government Employee can be asked to work overtime if required by Department task.

(2) Instruction as described in paragraph (1) is issued by Head of Office/Working Unit in Instruction to Work Overtime.

Article 3

(1) Civil Government Employee who works overtime each time more than 1 hour is given overtime allowance.

(2) Maximum overtime is 3 (three) hours per day or 14 (fourteen) hours in a week.

(3) In case overtime is in holiday, overtime can more than 3 hours in a day.

(4) Overtime allowance for every hour for employee is as follows:

a. In working day after closing time of office:

Group I : Rp5,000.00/hour;

Group II : Rp6,500.00/hour;

Group III : Rp8,000.00/hour;

Group IV : Rp9,500.00/hour.

b. Overtime allowance in holiday is 200% (two hundred percent) of overtime allowance in working day.

(5) Food allowance is paid once in a month in the next month.

Article 4

(1) Civil Government Employee who work overtime is given food allowance Rp 10,000.00 (ten thousand rupiah) after work overtime at least 2 (two) hours in a row.

(2) In case overtime work is done in holiday, food allowance only be given once.

CHAPTER III
OTHER PROVISION

Article 5

Procedure to ask and pay money for overtime allowance is stipulated by Director General of Treasury.

Article 6

With the enforcement of this Regulation of the Minister of Finance, Regulation of the Minister of Finance No. 640/KMK.04/1980 concerning Overtime and Giving Overtime Allowance for Civil Government Employee and Regulation of the Minister of Finance No. 583/KMK.03/1994 concerning Overtime and Giving Overtime Allowance for Government Employee shall be declared null and void.

CHAPTER IV
CLOSING PROVISION

Article 7

This regulation of the Minister of finance shall come into effect at the date of stipulation and valid from 1 January 2007.

In order for everyone to be informed the regulation shall be published in State Gazette of the Republic of Indonesia.
